Public Comments and Discussion: The public is invited at this time to comment on and discuss any item not on the agenda that is relevant to, or within the authority of, the Carson City Board of Supervisors, the Carson City Liquor and Entertainment Board and the Carson City Redevelopment Authority. No action may be taken on a matter raised under this item of the agenda until the matter itself has been specifically included on an agenda as an item upon which action will be taken. Public comment during individual agenda items will be taken on the item at the time the item is called for hearing.

All matters listed under the consent agenda are considered routine and may be acted upon by the Board of Supervisors with one action and without an extensive hearing. Any member of the Board or any citizen may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Mayor, or the Mayor Pro-Tem, retains discretion in deciding whether or not an item will be pulled off the consent agenda.
3-1. Assessor
Staff Summary: NRS 361.340 provides establishes the Carson City Board of Equalization as consisting of five members. The Carson City Board of Supervisors is required to appoint the members of the Board of Equalization by a majority vote and the Mayor is required to designate a member of the Board of Equalization as the chairperson
3-2. Justice Court
Staff Summary: NRS 4.032 allows for the Board of Supervisors to establish a panel of substitute Justices of the Peace (Justices of the Peace Pro-Tempore) for use whenever a Justice of the Peace is disqualified from acting in a case pending in the justices' court or is unable to perform his official duties because of his temporary sickness or absence, or other cause, he shall, if necessary, appoint a person from the panel of substitute justices of the peace.

3-4. Public Works
Staff Summary: Staff is asking that the Board of Supervisors approve the agreement between Melvin T. Cowperthwaite and Josephine G. Cowperthwaite, Trustees of the Cowperthwaite Family Trust, dated December 15, 1995, and Carson City for permission to construct outside of right-of-way necessary to construct the Orchard Road Water Line Project for a cost of approximately $11,867.
Staff Summary: Staff is asking that the Board of Supervisors approve the agreement between William Henry Thomas and Jenice Floyd Thomas as Trustees of the Jenice and William Thomas - 1995 Trust dated 4/25/1995, and Carson City for permission to construct outside of right-of-way necessary to construct the Orchard Road Water Line Project for a cost of approximately $6,747.
3-5. Health and Human Services
Staff Summary: This action will allow Carson City Health and Human Services to assist the University of Nevada, Reno, Orvis School of Nursing with instructional program for the benefit of training nursing students in the field of public health. We will provide student nurses training in our family planning, immunization clinic and public health preparedness activities.

Ordinances, Resolutions, and Other Items
4. City Manager
A) Presentation regarding the activities of the Nevada Tahoe Conservation District.
Staff Summary: Doug Martin, District Manager and Chris Freeman will provide a brief presentation and answer any questions.
Staff Summary: The Nevada Tahoe Conservation District functions under the auspices of NRS 548.283 which states the governing bodies of any counties located within the boundaries of the district shall appoint a representative to represent them as a supervisor on the governing board of the district.
5. Airport Authority
Staff Summary: In conjunction with other revisions to Title 19 of the Carson City Municipal Code which addresses permitted activities, operations, construction and safety issues on the Carson City Airport, the Authority proposed to relocate Section 19.05 which addresses Fees for Dissolution of Marriage to Title 2 of the Carson City Municipal Code which addresses other fees.
6. Public Works
Staff Summary: This water application proposes to assign Dayton Valley water rights owned by Lyon County to Carson City's Well 40. The use of groundwater from Carson City Well Number 40, pursuant to the agreement with Lyon County, will serve users within the service area of Carson City Water Utility, as well as the Dayton Valley portion of the service area of Lyon County Utilities.
7. Development Services - Planning and Zoning
A) Action to approve a Master Plan Amendment application from Lumos & Associates, Inc. (property owner: Boys & Girls Club of Western Nevada) to modify a portion of the Master Plan land use designation from High Density Residential to Public/Quasi-Public, on property located at 1870 Russell Way, APN 002-101-85. (MPA-08-044)

Staff Summary: The proposal would amend the boundaries of the Master Plan Land Use Map to remove the current High Density Residential designation from a 10.61 acre portion of the subject site and change it to the Public/Quasi-Public designation. The 3.49 acre remainder of the subject property would retain the existing High Density Residential designation for a future multi-family use.
Staff Summary: The proposed Zoning Map Amendment would allow a 10.61 acre portion of the property to be zoned Public Regional, resulting in land to be developed for the proposed Carson City Recreation Center, and a 3.49 acre portion of the property to be zoned Multi-Family Apartment.
Staff Summary: The proposed amendment would eliminate the current time restriction for display of banners of only 30 days within any 90 day period. This amendment was proposed by Supervisor Aldean to allow businesses to provide more advertising during difficult economic conditions. The ordinance would be reviewed in one year for continuation or repeal.
Staff Summary: The current subdivision approval will expire on January 18, 2009. This request would extend the Final Map recordation to January 18, 2010 to allow the applicant additional time to work through final design and coordination of the project, which involves subdividing two parcels into 45 industrial lots (44 lots ranging from 1,280 square feet to 5,600 square feet and one 5.17 acre common area lot) on a total of 7.84 acres.
8. City Manager
Staff Summary: CCMC Section 4.05.030 creates a five member advisory committee called the 9-1-1 Surcharge Advisory Committee. There are two applicants to fill two positions open due to terms expiring.
9. Board of Supervisors
Staff Summary: Board members serve on various Boards, Committees and Commissions. Each January appointments are made for the upcoming calendar year.
